Terms of Service

Effective date: 01 Jan 2025

These Terms govern your use of our website and services. By engaging Confetti Collective (“we”, “our”, “us”), you agree to these Terms. If you are entering into this agreement on behalf of a company or family, you represent that you have authority to bind that party.

1. Services & Bookings

We provide planning, design, production and hospitality coordination for events across India. A booking is confirmed when you accept our written proposal and pay the stated advance/deposit. Pre-booking proposals and moodboards are indicative and not binding until confirmation.

2. Fees, Deposits & Taxes

Fees, deliverables and timelines are specified in your proposal. Unless stated otherwise, prices are exclusive of applicable taxes (e.g., GST). Deposits are non-refundable except as expressly stated below. Bank/UPI charges by your provider are your responsibility.

3. Changes & Overtime

Reasonable changes are welcome. Material scope changes (guest count, venue, date, design) may require a change order and price/time adjustments. Overtime, night differentials, and additional vendor hours are billable at the rates in your proposal or our standard rates.

4. Client Responsibilities

  • Provide accurate event details and timely approvals.
  • Secure venue permissions, licenses and local permissions as applicable (noise, alcohol, fire, civic permissions), unless our proposal states we will obtain them.
  • Ensure access and basic utilities (power, water, load-in) and safe working conditions for all vendors.
  • Nominate one decision-maker for quick approvals on the event day.

5. Vendors & Third Parties

We may recommend vendors, but you remain the contracting party unless otherwise agreed. If we contract vendors on your behalf, you authorise us to manage them; you are responsible for vendor costs and cancellation fees. We are not liable for acts/omissions of independent vendors.

6. Cancellation & Postponement

If you cancel: (a) more than 60 days before the event — we retain the deposit and refund any unused pass-through vendor costs subject to vendor terms; (b) 31–60 days — 50% of the total fee is due; (c) 0–30 days — 100% of the total fee and confirmed vendor costs are due. Postponements are treated as cancellations unless a new date is mutually agreed and all vendors can accommodate; rescheduling fees may apply.

7. Force Majeure

Neither party is liable for delays or non-performance caused by events beyond reasonable control (e.g., severe weather, floods, strikes, government orders). Fees already earned for work performed remain payable. We will use reasonable efforts to mitigate and reschedule.

8. Intellectual Property & Publicity

We retain IP in our designs, documents, schedules and photographs we create, except content you provide. We grant you a personal, non-transferable licence to use deliverables for your event. Unless you opt out in writing, you grant us permission to display event images and factual descriptions for portfolio and social media. You may revoke future publicity permission at any time.

9. Privacy

Our Privacy Policy explains how we collect and use personal data. By using our services, you acknowledge that policy.

10. Warranties & Disclaimers

We will perform services with reasonable care and skill. Except as expressly stated, services are provided “as is” and we disclaim all other warranties to the fullest extent permitted by law.

11. Liability & Indemnity

To the extent permitted by law, our aggregate liability arising from the services is limited to the fees you paid to us for the engagement giving rise to the claim. Neither party is liable for indirect, special, or consequential losses. You agree to indemnify us against third-party claims arising from your breach of these Terms, venue violations, or unsafe instructions.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any dispute will be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Mumbai, Maharashtra, with proceedings in English before a sole arbitrator mutually appointed by the parties.

13. Miscellaneous

  • Entire agreement: your accepted proposal + these Terms form the entire agreement.
  • Severability: if any provision is unenforceable, the rest remain in effect.
  • Assignment: you may not assign without our consent; we may assign to affiliates.
